NRC ORDER – CPORDER $43,500

On October 9, 2019, the NRC issued an Order Imposing a Civil Monetary Penalty in the amount of $43,500 to Solis Tek, Inc. The civil penalty was imposed after a June 2019 letter from Solis Tek that responded to the NRC Notice of Violation and Proposed Imposition of Civil Penalty (NOV CP) for $43,500 issued on May 15, 2019 and based on a Severity Level III Problem. In its letter, Solis Tek requested to terminate its license and engage in the NRC Alternate Dispute Resolution (ADR) process for the purposes of mitigating the proposed civil penalty amount. NRC identified that it was not in the NRC or public interest to pursue ADR because the license was being terminated, and, without any further basis for mitigation provided, the civil penalty amount would remain the same for imposition. The initial NOV CP identified a Severity Level III problem for the following violations: (1) willful failure to obtain an NRC license authorizing distribution of licensed material to unlicensed persons prior to beginning exempt distribution (10 CFR 30.15 and 32.14), (2) failure to obtain an NRC license authorizing exempt distribution of licensed material to unlicensed persons prior to beginning distribution (10 CFR 30.15 and 32.14), (3) failure to receive authorization to import radioactive material into the United States by a general or specific license under the regulations in 10 CFR Part 110, prior to importing such material, and (4) failure to submit a timely annual report for 2017 on or before January 31, 2018 (10 CFR 32.16).
